This page describes the framework under which GangDeCartes entrusts the operation of a collectible card vending machine to a franchisee. It is provided for information: it is not the franchise agreement, does not replace the documents given to a candidate before any commitment, and does not constitute an offer. Only the documents signed between the parties govern. GangDeCartes is a sole proprietorship registered in Quebec under business number (NEQ) 2281489767.
GangDeCartes (the “Franchisor”) makes a vending machine (the “Machine”) available to an independent operator (the “Franchisee”), who operates it in their own name and on their own behalf under the network's banner. The Machine is neither sold nor rented to the Franchisee: it is made available for the term of the franchise agreement.

The Franchisee operates their Machine: they stock it, manage inventory, set their own retail prices, collect their sales and meet their tax and regulatory obligations. They are solely responsible for the compliance of the products they offer for sale and for the commercial results of their operation.
The Machine remains the property of the Franchisor at all times. The Franchisee becomes neither its owner nor its tenant. They assume custody of it from installation, use it with due care and for its intended purpose, and return it in good condition at the end of the agreement, subject to normal wear.
The financial terms of the franchise are set out in the agreement and disclosed to the candidate during the discussion that follows their application. They are not published on this site. The Franchisor earns revenue both from the franchise relationship and from supplying cards to the network.
The operating site is agreed between the parties and reserved for the Franchisee for the term of the agreement. The Franchisor grants no territorial exclusivity: the reservation covers the agreed site, not a city, a region or a province.
The Franchisor supplies the Franchisee with the cards for the Machine, which the Franchisee orders from it on the terms set out in the agreement. It guarantees neither the permanent availability of any given item, nor a price level, nor a sales volume, as collectible card markets are subject to shortages and price swings beyond its control.
Several Canadian provinces require a franchisor to give a candidate a disclosure document within a set period before any signature or payment. The documents required by the province concerned are given to the candidate before they commit. This page is not that document.
The term of the agreement, its renewal conditions and how it ends are set out in the agreement. Should either party seriously fail to meet its obligations and not remedy this within a reasonable time after written notice, the other party may terminate as of right, without prejudice to damages. The Machine is returned to the Franchisor when the relationship ends.
The Franchisor services the Machine and provides technical support for the hardware on the terms set out in the agreement. Not covered: damage resulting from improper use, from a lack of routine care attributable to the Franchisee, or from unauthorised work.
The Franchisor is bound by an obligation of means. It guarantees no revenue and no profitability: the operation belongs to the Franchisee, who takes it on as an independent business owner. Save for mandatory legal provisions, the Franchisor's liability does not cover indirect damages.
Personal information collected as part of an application or of the contractual relationship is processed in accordance with Law 25 (Quebec) and our privacy policy.
This page is governed by the law applicable in the province of Quebec (Canada). The law governing the franchise agreement and the competent jurisdiction are set out in the agreement, taking into account the mandatory rules of the province where the Machine is operated.
The Franchisor may update this page at any time to reflect how the network evolves. What binds the parties remains what is set out in the documents they have signed.
